1. APPLICABILITY

    This usage policy is applicable to all iKNOW Policy users and members and refers to all the resources, links, and other content available on the iKNOW Politics Web site.

  2. MEMBER/USER CONDUCT
    1. The iKNOW Politics users and members agree to respect the rights of others to their privacy, intellectual property and other rights, including but not limited to copyrights and licenses.
    2. The iKNOW Politics users and members agree to respect the integrity of iKNOW Politics resources and the Web site and refrain from seeking to gain unauthorized access.
    3. The iKNOW Politics users and members agree not to use the iKNOW Politics network to:
      1. post, transmit or otherwise make available any content or resources that are unlawful, harmful, violent, harassing, tortuous, defamatory, threatening, obscene, infringing of another’s privacy, or racially, religiously, ethnically or otherwise offensive;
      2. harass or insult the dignity and honour of other iKNOW Politics users, members, staff and the Steering Committee members;
      3. post, transmit or otherwise make available any content or resources that they do not have a right to make available under any law or any other contractual agreements;
      4. conceal the origin and copyright holder of any content posted, transmitted or otherwise made available through the iKNOW Politics Web site;
      5. post, transmit or otherwise make available any content or resources that violates patent, trademark, trade secret, copyright or other proprietary rights of any party;
      6. post, transmit or otherwise make available any unauthorized advertising, promotional materials, ‘spam’ or any other form of solicitation;
      7. post, transmit or otherwise make available any content or resources that contains software viruses or any other files or programs designed to interrupt, damage or constrain the functionality of any computer software or hardware or any communications equipment;
      8. disrupt the functioning of the iKNOW Politics Web site or networks connected to the iKNOW Politics Web site, or disobey any requirements, procedures, policies or regulations of networks connected to the iKNOW Politics Web site;
      9. intentionally or unintentionally violate any applicable local, state, national or international laws and agreements using iKNOW Politics Web site.
    4. iKNOW Politics users and members acknowledge the following:
      1. iKNOW Politics staff and its Steering Committee members have the right, but are not obligated, to pre-screen any content or resources posted or proposed to be posted or transmitted on the iKNOW Politics Web site;
      2. iKNOW Politics staff and its Steering Committee members have the right to refuse to post on or remove from the iKNOW Politics Web site any content or resources;
      3. iKNOW Politics staff and its Steering Committee have the right to remove any content, including the content generated in any iKNOW Politics discussion circles, that violates the usage or privacy policies or is otherwise objectionable.
    5. The iKNOW Politics users and members acknowledge and agree that the iKNOW Politics project and its Steering Committee may access, preserve and disclose their account information and content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to:
      1. comply with a legal process; (b) enforce the terms of this user or privacy policies;
      2. respond to claims that the content violates the rights of third parties;
      3. respond to other members’ requests; or (e) protect the rights, property or personal safety of the iKNOW Politics project, its Steering Committee members, iKNOW Politics users and members.
    6. The iKNOW Politics users and members understand that the iKNOW Politics Web site, including iKNOW Politics software embodied within the network may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by copyright laws. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the network, in whole or in part, is strictly prohibited.
  3. NON-LIABILITY TO MEMBERS/USERS
    1. The iKNOW Politics users and members understand that all information, including discussions on message boards and resource materials, are the sole responsibility of the person from whom they were posted or originated.
    2. The iKNOW Politics users and members understand that by using the iKNOW Politics Web site, they may be exposed to the content that is offensive, indecent or objectionable. Under no circumstances will the iKNOW Politics project or its Steering Committee members be liable in any way for any Web site content posted, emailed, transmitted or otherwise made available via the network.
    3. The iKNOW Politics users and members understand that under no circumstances will the iKNOW Politics project or its Steering Committee members be liable in any way for any loss or damage of any kind to their software or hardware or any other resources incurred as a result of the use of any content or resource posted, emailed, transmitted or otherwise made available via the network.
    4. The iKNOW Politics users and members agree to evaluate, and bear all risks associated with, the use of any content or resources posted on the iKNOW Politics Web site or the networks connected to it, including reliance on the accuracy, completeness or usefulness of such content and resources. This article is also relevant to the content and information generated in any of the iKNOW Politics Discussion circles.
  4. MEMBER ACCOUNT, PASSWORD AND SECURITY
    1. The iKNOW Politics members will receive a password and account designation upon completing the registration process to create their personalized profile on myKNOW Politics space and enjoy access to additional resources on the iKNOW Politics Web site.
    2. The iKNOW Politics members agree to:
      1. provide accurate, true and complete information about themselves in the member registration form;
      2. maintain and promptly update their profiles to keep it accurate, true and complete.
    3. The iKNOW Politics members are responsible for maintaining the confidentiality of their password and account and are fully responsible for all activities that occur under their passwords or accounts.
    4. iKNOW Politics members agree to the following:
      1. immediately notify iKNOW Politics Web master of any unauthorized use of their passwords or accounts or any other breach of security;
      2. ensure that they log off from their accounts at the end of each session.

      iKNOW Politics and its Steering Committee members are not liable for any loss or damage arising from the failure of the iKNOW Politics members to comply with this section.

    5. The iKNOW Politics members agree that the iKNOW Politics project and its Steering Committee members may, under certain circumstances and without prior notice, terminate their iKNOW Politics accounts, any associated email addresses and access to the iKNOW Politics Web site due to the following reasons:
      1. breaches or violations of this and the iKNOW Politics privacy policies;
      2. requests by law enforcement or other government agencies;
      3. a self-initiated request to terminate the account;
      4. unforeseen technical or security problems;
      5. member’s involvement in illegal activities.
    6. Termination of the iKNOW Politics member accounts includes the removal of access to all offerings within the iKNOW Politics Web site, including, but not limited to, the MyKNOW Politics account.
  5. CONTENT SUBMITTED OR MADE AVAILABLE ON IKNOW POLITICS WEBSITE

    The iKNOW Politics project and its Steering Committee members do not claim the ownership of any content submitted or made available for inclusion on the iKNOW Politics Web site by the users and members. However, with respect to content submitted or made available for inclusion on publicly accessible areas of the iKNOW Politics Web site, users and members grant the iKNOW Politics project and its Steering Committee members the following non-exclusive rights:

    1. the right to use and publicly display such content, including the content generated in any of the iKNOW Politics discussion circles, on the iKNOW Politics Web site solely for the purposes of achieving and promoting the goals of iKNOW Politics project;
    2. the right to use and publicly display any photos, graphics, audio or video on the iKNOW Politics Web site solely for the purposes of achieving and promoting the goals of iKNOW Politics project.
  6. COPYRIGHTS

    The iKNOW Politics Web site contains copyrighted material and/or other proprietary information that may be copyrighted by the partner organizations or third parties and, thus, are protected by copyright laws and international intellectual property regulations. The iKNOW Politics users and members worldwide should acknowledge the original source(s) and the author(s) of any material/resources contained on or otherwise made available through the iKNOW Politics Web site while redistributing, publishing, copying or using such documents for any other non-commercial exploitation purposes.

  7. NON-COMMERCIAL USE

    The iKNOW Politics users and members agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the iKNOW Politics Web site content, including, but not limited to, the resources posted on the iKNOW Politics Resource Library and discussion circles.

  8. INDEMNITY

    The iKNOW Politics users and members agree to indemnify and hold the iKNOW Politics project and its Steering Committee members, as well as iKNOW Politics members harmless from any claims, including reasonable attorneys’ fees, inflicted from the claims of a third party due to any content posted, transmitted or otherwise made available through the iKNOW Politics Web site.

  9. MODIFICATIONS AND DISCONTINUATION OF FUNCTIONING

    The iKNOW Politics project and its Steering Committee members preserve the right at any time to modify or discontinue, temporarily or permanently, the functioning and content of the iKNOW Politics Web site.

  10. LINKS

    The iKNOW Politics Web site may include links to other World Wide Web sites or resources. Since the iKNOW Politics project and its Steering Committee members have no control over such sites and resources, iKNOW Politics users and members acknowledge and agree that the iKNOW Politics project and its Steering Committee members are not responsible for the content, including any images, graphics, video or audio materials, advertising products or other materials available from such sites or resources. iKNOW Politics members and users further acknowledge and agree that the iKNOW Politics project and its Steering Committee members shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused due to the use of any content available on or through the iKNOW Politics Web site.

  11. DISCLAIMER OF WARRANTIES

    MEMBERS AND USERS EXPRESSLY UNDERSTAND AND AGREE THAT:

    1. The use of the iKNOW Politics Web site is at their sole risk. The service is provided on an ‘as is’ and ‘as available’ basis;
    2. The iKNOW Politics project and its Steering Committee members make no warranty that (i) the service will meet each member’s or user’s requirements; (ii) the services of iKNOW Politics Web site will be uninterrupted, timely, secure or error-free; (iii) the results that may be obtained from the use of the iKNOW Politics Web site will be accurate or reliable; and (iv) the quality of any services, information or other material obtained through the iKNOW Politics Web site will meet each member’s or user’s expectations;
    3. Any material downloaded or otherwise obtained through the use of the iKNOW Politics Web site is accessed at members’ and users’ own discretion and risk, and they will be solely responsible for any damage to their computer system or loss of data that results from the download of any such material.
  12. LIMITATION OF LIABILITY

    The iKNOW Politics users and members expressly understand and agree that the iKNOW Politics Web site and its Steering Committee members shall not be liable to them for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses.
